Under Musk’s leadership, however, DOGE has allegedly pushed aside these traditional safeguards, consolidating control over systems that impact millions of Americans. Treasury Department databases, which handle federal payments such as Social Security benefits and tax refunds, are among those targeted by DOGE. If the task force is indeed processing data outside of the existing regulatory framework, this could constitute unauthorized government surveillance or even data misuse.

Federal Privacy Laws at Risk

The ACLU has highlighted possible violations of several federal laws, including the Privacy Act and the Federal Information Security Modernization Act (FISMA). These laws were designed to limit government overreach when handling citizens’ personal records. If DOGE’s access lacks proper oversight, there’s a real possibility that personal data could be analyzed or even weaponized against individuals deemed ideologically out of step with the administration.

The Privacy Act explicitly prevents the government from accessing personally identifiable information without expressed legal justification. In response to these concerns, the ACLU has filed Freedom of Information Act (FOIA) requests to obtain records of DOGE’s internal communications. The goal is to uncover exactly how the task force obtained access to Treasury and Office of Personnel Management (OPM) databases, as well as what measures, if any, are being taken to comply with federal privacy laws.

The ACLU is particularly interested in DOGE’s use of artificial intelligence (AI) to process government data. If AI-driven tools are being deployed without public knowledge or proper legal constraints, they could amplify the risk of discrimination or politically motivated employment actions. Given Musk’s own statements advocating for increased government efficiency, some fear that DOGE might be using such tools to track and purge employees based on ideological alignment rather than job performance.

Congress’ Role: Will There Be Oversight?

Despite the gravity of the allegations, it remains unclear whether Congress will step in to investigate DOGE’s conduct. Lawmakers have a constitutional duty to ensure that federal agencies operate within the bounds of the law. Yet, given the current political climate, oversight committees may find themselves divided along partisan lines.

The ACLU insists that transparency is not a partisan issue. Americans—regardless of political affiliation—deserve to know whether their financial, medical, and employment records are being examined without their consent. If DOGE has indeed bypassed longstanding privacy protections, Congress will have to decide whether it is willing to hold the administration accountable or allow executive power to expand unchecked.

The coming weeks will be critical in determining the extent of DOGE’s influence over federal databases. If the FOIA requests reveal clear legal violations, the ACLU and other civil rights organizations may push for formal investigations or legal action. Conversely, if DOGE’s operations remain shrouded in secrecy, the public may never fully grasp the scale of what is happening behind closed doors.

Regardless of the outcome, the debate surrounding DOGE is far from over. At its core, this controversy forces Americans to confront a fundamental question: How much control should an unelected government task force have over personal data?
